Welcome to the “Bright Memory” and “My Care Management” services, designed to enhance aged care services. By accessing or using these services, you agree to comply with and be bound by these Terms and Conditions, which are crafted in compliance with the Australian Aged Care Act and relevant privacy laws. If you do not agree to these terms, please do not use these services.
2. Acceptance of Terms
Your access to and use of the services provided by Bright Memory and My Care Management services signify your acceptance of these Terms and Conditions and your agreement to be legally bound by them.
3. Use of the Services
3.1. Eligibility: You must be of legal age and have the necessary legal capacity to enter into this agreement. For users within aged care facilities, consent must be obtained in accordance with their capacity to consent as defined under the Aged Care Act. 3.2. Account Management: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Use of the account must comply with the standards set forth by the Aged Care Quality and Safety Commission.
4. Privacy and Data Management
Your privacy and the security of your personal information are paramount. Our Privacy Policy complies with the Australian Privacy Principles and outlines our practices concerning the collection, use, and disclosure of your information, including special provisions for handling health and personal information in an aged care context.
5. Rights of Residents
We affirm the rights of consumers as outlined in the Aged Care Act, including the right to dignity, respect, privacy, and to make decisions about their own care. These rights are central to our operations and service delivery.
6. Quality of Care

The content, features, and intellectual property of the services are owned by “Bright Memory.” Use of these resources is subject to your compliance with these Terms and Conditions.

12. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Australian states and territories, and any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts of this jurisdiction.
